What Does Pizza Have To Do With Asset Protection?

You may have read that the founder of Papa John’s Pizza, John Schnatter, has stepped down as chairman of the company due to offensive language he used on a business call.

Now he’s getting divorced and has also filed a lawsuit against the ad agency that was on the other end of Schnatter’s disastrous call. Of course, these celebrity lawsuits receive a ton of attention, but what’s going on with the rest of us?

There are over 40 million lawsuits filed in the U.S. each year and it’s a growth industry. Minor fender benders lead to claims of neck and back injuries, tenants are using mold claims to sue for huge dollars, and claims such as “wage an hour” are everywhere.

Below are examples of potential liability:

1. Wealth Manager gets sued by client because an LLC was not used for the investment account and the client’s creditor is reaching right in to grab the assets.
2. Dentist gets sued by employees for wage and hour issues.
3. Franchise owner signs a personal guarantee to expand his business and new location goes belly-up. Lender comes after owner hard.
4. Business owner’s spouse gets into a fender bender. Spouse gets sued for injury and the business of the owner gets attacked.
5. Tenant slips on back stairs of rental unit and claims the fall was due to slippery algae on the stairs. Tenant wins big lawsuit and owner loses building.
